Is it required?
If you have employees, or are responsible for a contractor, then workers compensation is required. Whether or not you are responsible for an employee or contractor can be determined by a number of factors.
If your company or organization controls what the worker does and how they do their job, they are considered an employee you are responsible for.
If your company controls how they’re paid, whether expenses are reimbursed, and who provides tools and supplies, they would be considered an employee you are responsible for.
Do you have a written contract, and do you offer employee-type benefits to them? Will they continue to work for you? Is the individual’s work essential to your business?

What’s covered
Workers’ compensation insurance covers employees for injuries and illnesses sustained during employment:

Workers’ compensation insurance also covers an employer’s legal defense fees and settlements/judgments, should an injured employee sue for negligence.
Workers’ compensation insurance does not cover every workplace injury. Coverage may be denied if any of the following apply to the injury:
- Originated outside the workplace
- Resulted from a workplace fight
- Related to a felony
- Claimed after an employee is terminated or laid off
- Caused while the employee was under the influence of alcohol or drugs
